Welcome to Jobyo! These Terms of Service (“Terms”) govern your access to and use of Jobyo’s website, mobile and web applications, APIs, and other services (collectively, the “Service”), operated by Jobyo Inc. (“Jobyo”, “we”, “us”, or “our”).

By using Jobyo, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Service.

1. Eligibility and Account Responsibilities

To use Jobyo, you must be at least 18 years old or the age of majority in your jurisdiction. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including that of any users you authorize.

You agree to provide accurate and complete information when creating an account and to keep it up to date.

2. Subscriptions, Billing, and Pricing Changes

Jobyo is a subscription-based SaaS platform. By subscribing, you agree to pay all applicable fees based on your selected plan.

  • Payments are billed in advance on a recurring basis (monthly or annually) through our payment processor (e.g., Stripe).
  • Your subscription will renew automatically unless you cancel it before the end of the current billing period.
  • You may cancel your subscription at any time through your account dashboard. We do not offer prorated refunds unless required by law.
  • We reserve the right to modify our pricing or subscription features at any time. We will provide advance notice via email or in-app message. Continued use of the Service after changes take effect constitutes your acceptance.

3. Free Trials

We may offer free trial periods. Trials are limited to one per company unless otherwise approved. After a trial ends, you will be charged unless you cancel before the billing date.

4. Acceptable Use Policy

You agree not to misuse the Service. You must not:

  • Violate any applicable law or regulation
  • Infringe upon the rights of others
  • Attempt to reverse-engineer, decompile, or extract source code
  • Transmit viruses, malware, or harmful content
  • Use excessive bandwidth or storage in a way that disrupts the system
  • Access or use the Service to build a competing product

Jobyo reserves the right to investigate and suspend accounts engaged in abusive or prohibited behavior.

5. Intellectual Property

All content, software, branding, and underlying technology on the Jobyo platform are the property of Jobyo or its licensors. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service under these Terms.

You retain ownership of the content and data you submit to Jobyo. By uploading content, you grant us permission to process and store it for the purpose of providing the Service.

6. Third-Party Services

Jobyo may integrate with third-party platforms (e.g., Google, Microsoft, QuickBooks, Stripe). Your use of those services is governed by their terms and policies. Jobyo is not responsible for third-party service availability or data handling practices.

7. Data Privacy and Security

Our data practices are governed by our Privacy Policy. We implement technical and organizational safeguards to protect your data.

You are responsible for maintaining secure access credentials and ensuring that authorized users comply with security best practices.

8. Data Retention and Deletion

Upon cancellation or termination of your account, we may retain your data for a limited time (e.g., 30 days) to allow export or compliance with legal requirements. After that, we may delete your data unless legally required to retain it.

9. Service Availability and Data Loss

We strive to keep Jobyo available at all times, but we do not guarantee uninterrupted or error-free operation. You acknowledge that occasional downtime, bugs, or technical issues may occur.

You agree that Jobyo is not liable for any data loss, service interruptions, or system failures, whether caused by us, you, or third-party providers. We recommend exporting important data regularly.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Jobyo shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities.
  • Our total liability for all claims related to the Service shall not exceed the amount paid by you to us in the preceding 12 months.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be secure, error-free, or meet your specific needs.

12. Termination

You may terminate your account at any time through your dashboard. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees, or pose a legal risk to us.

Upon termination, your right to use the Service ceases immediately. Any provisions that by their nature should survive termination will remain in effect (e.g., ownership, liability, data).

13. Changes to the Terms

We may modify these Terms at any time. Changes will be posted on this page with an updated effective date. If changes are material, we will notify you via email or in-app message. Continued use after changes means you accept the new Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Montreal, Quebec.
